Amends the Illinois Insurance Code. Provides that notwithstanding any other statutory provision or common law rule, any insurance company subject to regulation under the Code and any of its agents, servants, or employees are not liable and no cause of action arises with respect to any accident or injury based on the allegation that the accident or injury was caused, directly or indirectly, or could have been prevented by, a program, information, inspection, or other activity or service undertaken by an insurance provider for the prevention of accidents, control of losses, or improvement of health and welfare in connection with operations of the insured. Provides that this immunity does not affect the liability of an insurance provider otherwise provided by an insurance policy or plan. Effective immediately.

| Be it enacted by the People of the State of Illinois,
|

| represented in the General Assembly:
|

| Section 5. The Illinois Insurance Code is amended by adding |
5 |
| Section 144.3 as follows: |

| (215 ILCS 5/144.3 new) |

| Sec. 144.3. Accident immunity for insurance providers. |
8 |
| Notwithstanding any other statutory provision or common law |
9 |
| rule, any insurance company subject to regulation under this |
10 |
| Code and any of its agents, servants, or employees are not |
11 |
| liable and no cause of action arises with respect to any |
12 |
| accident or injury based on the allegation that the accident or |
13 |
| injury was caused, directly or indirectly, or could have been |
14 |
| prevented by, a program, information, inspection, or other |
15 |
| activity or service undertaken by an insurance provider for the |
16 |
| prevention of accidents, control of losses, or improvement of |
17 |
| health and welfare in connection with operations of the |
18 |
| insured. This immunity does not affect the liability of an |
19 |

| Section 99. Effective date. This Act takes effect upon |
22 |
| becoming law.
