| AMENDMENT NO. ______. Amend House Bill 4998, AS AMENDED, in |

| Section 5, by replacing subsections (a) and (b) of Sec. |

| 11-503.5 with the following:

| "(a) A person commits distracted driving when he or she |
| 6 |
| operates a motor vehicle while (i) engaging in text messaging, |
| 7 |
| (ii) reading a newspaper, book, magazine, or map, (iii) |
| 8 |
| applying make-up, or (iv) changing clothes or tying a tie, and |
| 9 |
| the operation of the motor vehicle is in violation of a law or |
| 10 |
| ordinance governing the movement of vehicles. |
| 11 |
| (b) A law enforcement officer may charge a person with |
| 12 |
| distracted driving under this Section if the officer has |
| 13 |
| stopped the person for any violation of a law or ordinance |
| 14 |
| governing the movement of vehicles and if the officer |
| 15 |
| determines that the driver was driving while distracted; |
| 16 |
| however, the offense of distracted driving is not deemed to be |
| 17 |
| a violation of a law or ordinance governing the movement of |
| 18 |
| vehicles and may not be recorded on the driving record of the |
