Amends the Illinois Public Aid Code. Provides that within 90 days after the effective date of this amendatory Act, the Illinois Department of Healthcare and Family Services shall seek federal approval to amend the State Medicaid Plan to disregard applicant income up to 115% of the Federal Poverty Level in applying the income eligibility requirements for the Qualified Medicare Beneficiary, Special Low Income Beneficiary, and Qualified Individual programs. Effective immediately.

| AN ACT concerning public aid.

| Be it enacted by the People of the State of Illinois,
|

| represented in the General Assembly:
|

| Section 5. The Illinois Public Aid Code is amended by |
5 |
| adding Section 5-2.10 as follows: |

| (305 ILCS 5/5-2.10 new) |

| Sec. 5-2.10. Medicare savings programs. Within 90 days |
8 |
| after the effective date of this amendatory Act of the 95th |
9 |
| General Assembly, the Illinois Department of Healthcare and |
10 |
| Family Services shall seek federal approval to amend the State |
11 |
| Medicaid Plan to disregard applicant income up to 115% of the |
12 |
| Federal Poverty Level in applying the income eligibility |
13 |
| requirements for the Qualified Medicare Beneficiary, Special |
14 |
| Low Income Beneficiary, and Qualified Individual programs.

| Section 99. Effective date. This Act takes effect upon |
16 |
| becoming law.
