| AN ACT concerning local government.
|

| Be it enacted by the People of the State of Illinois, |
| 3 |
| represented in the General Assembly:
|
| 4 |
| Section 5. The Counties Code is amended by changing Section |
| 5 |
| 5-1049 as follows:
|
| 6 |

| Sec. 5-1049. Public grounds. A county board may accept or |
| 8 |
| receive
through gift, grant, legacy, dedication in plats of |
| 9 |
| subdivision or
otherwise, parks, playgrounds, areas enclosing |
| 10 |
| flood plains, floodwater
runoff channels and
and detention |
| 11 |
| ponds or basins, and other public grounds and
easements located |
| 12 |
| in the unincorporated part of the county and not accepted
by a |
| 13 |
| municipality, park district or other public agency; may
hold |
| 14 |
| and maintain such grounds and lands; may supervise or
regulate |
| 15 |
| their use for any proper public purpose; and may enact
|
| 16 |
| ordinances or resolutions to provide for monetary relief for |
| 17 |
| damages caused
by filling or dumping into areas enclosing |
| 18 |
| floodplains, floodwater runoff
channels or detention ponds or |
| 19 |
| basins. Monetary relief for such damages
shall be based on the |
| 20 |
| cost of removing soil, debris, rubbish or any other
material |
| 21 |
| from the floodplain, floodwater runoff channel or detention |
| 22 |
| pond
or basin. |
