Amends the Criminal Code of 1961. Creates the offense of negligent discharge of a firearm. Defines the offense as discharging a
firearm in
a negligent manner which endangers the bodily safety
of an individual. Provides that the offense is a Class A misdemeanor. Exempts from a violation a peace officer while in the performance of his or her official duties.

| AN ACT concerning criminal law.
|

| Be it enacted by the People of the State of Illinois,
|
3 |
| represented in the General Assembly:
|

| Section 5. The Criminal Code of 1961 is amended by adding |
5 |
| Section 24-1.5-1 as follows: |

| (720 ILCS 5/24-1.5-1 new) |
7 |
| Sec. 24-1.5-1. Negligent discharge of a firearm. |

| (a) A person commits negligent discharge of a firearm by |
9 |
| discharging a
firearm in
a negligent manner which endangers the |
10 |
| bodily safety
of an individual. |

| (b) Sentence. Negligent discharge of a firearm is a Class A |
12 |
| misdemeanor. |
13 |
| (c) This Section does not apply to a peace officer while in |
14 |
| the performance
of his or her official duties.
