Amends the Nursing Home Care Act. Provides that the Department of Public Health may develop a program to collaborate with long-term care facilities on quality assurance issues. Provides that the Department may seek all necessary waivers of federal requirements to permit the full implementation of the program, and provides that implementation of the program is subject to the availability of funding for that purpose. Effective immediately.

| AN ACT concerning regulation.

| Be it enacted by the People of the State of Illinois,
|

| represented in the General Assembly:
|

| Section 5. The Nursing Home Care Act is amended by adding |
5 |
| Section 3-217 as follows: |

| (210 ILCS 45/3-217 new) |
7 |
| Sec. 3-217. Quality Assurance Review. The Department may |
8 |
| develop a program to collaborate with facilities on quality |
9 |
| assurance issues, the scope of which shall be set forth in |
10 |
| rules. The Department may seek all necessary waivers of federal |
11 |
| requirements to permit the full implementation of the program. |
12 |
| Implementation of the program is subject to the availability of |
13 |
| funding for that purpose.

| Section 99. Effective date. This Act takes effect upon |
15 |
| becoming law.
