| AN ACT concerning criminal law.

| Be it enacted by the People of the State of Illinois,
|
| 3 |
| represented in the General Assembly:
|
| 4 |
| Section 5. The State Appellate Defender Act is amended by |
| 5 |
| changing Section 10.6 as follows:
|

| (725 ILCS 105/10.6)

| Sec. 10.6. Expungement program.
|
| 8 |
| (a) The The State Appellate Defender shall establish, |
| 9 |
| maintain, and carry out an
Expungement Program
to provide |
| 10 |
| information to persons eligible to have their arrest
or |
| 11 |
| criminal history
record information ordered expunged, sealed, |
| 12 |
| or impounded.
|
| 13 |
| (b) The State Appellate Defender shall develop brochures, |
| 14 |
| pamphlets, and
other
materials in
printed form and through the |
| 15 |
| agency's World Wide Web site. The pamphlets and
other materials |
| 16 |
| shall
include at a minimum the following information:
|
| 17 |
| (1) An explanation of the State's expungement process;
|
| 18 |
| (2) The circumstances under which expungement may |
| 19 |
| occur;
|
| 20 |
| (3) The criminal offenses that may be expunged;
|
| 21 |
| (4) The steps necessary to initiate and complete the |
| 22 |
| expungement process;
and
|
| 23 |
| (5) Directions on how to contact the State Appellate |
