| ||||||
2 | WHEREAS, House Joint Resolution 80 which established the | ||||||
3 | Long-Term Prisoners Study Committee was adopted by both houses | ||||||
4 | of the Ninety-Fourth General Assembly; and
| ||||||
5 | WHEREAS, The Long-Term Prisoners Study Committee was | ||||||
6 | directed to: consider whether life without parole and long-term | ||||||
7 | sentences in excess of 30 years are necessary for public safety | ||||||
8 | and provide the best use of State funds; and report its | ||||||
9 | findings and recommendations to the General Assembly in a final | ||||||
10 | report which was to be filed on or before June 1, 2007; and
| ||||||
11 | WHEREAS, The Long-Term Prisoners Study Committee does not | ||||||
12 | have sufficient time to carry out its duties before the June 1, | ||||||
13 | 2007 date set for its report and recommendations; and
| ||||||
14 | WHEREAS, The Ninety-Fifth General Assembly needs to | ||||||
15 | reauthorize the Long-Term Prisoners Study Committee with the | ||||||
16 | same membership and charge as the Committee authorized by HJR | ||||||
17 | 80 of the Ninety-Fourth General Assembly and set the date for | ||||||
18 | the report and recommendations as on or before December 31, | ||||||
19 | 2007; and

20 | WHEREAS, As stated in HJR 80, it costs at least $1,000,000 | ||||||
21 | to confine a person in prison for 30 years; and

1 | WHEREAS, As stated in HJR 80, The recidivism rate for long | ||||||
2 | termers is the lowest of any group of prisoners and a large | ||||||
3 | number of lifers and long-term prisoners are sentenced under | ||||||
4 | the accountability theory and not for the actual commission of | ||||||
5 | the crime, and some are first time offenders; therefore, be it
| ||||||
6 | RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE | ||||||
7 | NINETY-FIFTH GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, THE | ||||||
8 | SENATE CONCURRING HEREIN, that there is hereby established the | ||||||
9 | Long-Term Prisoners Study Committee; and be it further
| ||||||
10 | RESOLVED, That the Committee shall have the following | ||||||
11 | members: 17 members, as follows: 3 members appointed by the | ||||||
12 | President of the Senate, 2 members appointed by the Senate | ||||||
13 | Minority Leader, 3 members appointed by the Speaker of the | ||||||
14 | House of Representatives, 2 members appointed by the House | ||||||
15 | Minority Leader; one member appointed by the Attorney General;

16 | one member appointed by the Governor;
one member appointed by | ||||||
17 | the Cook County State's
Attorney;
one member appointed by the | ||||||
18 | Office of the Cook County
Public Defender;
one member appointed | ||||||
19 | by the Office of the State
Appellate Defender;
one member | ||||||
20 | appointed by the Office of the State's
Attorneys Appellate | ||||||
21 | Prosecutor; and
one member appointed by the Director of | ||||||
22 | Corrections;
and be it further |

1 | RESOLVED, That any member of the Ninety-Fifth General | ||||||
2 | Assembly who was previously appointed to the Committee | ||||||
3 | established by HJR 80 of the Ninety-Fourth General Assembly | ||||||
4 | shall remain as member of the Committee, unless the individual | ||||||
5 | who holds the position responsible for making the appointment | ||||||
6 | determines otherwise; and be it further | ||||||
7 | RESOLVED, That all actions of the Committee require the | ||||||
8 | affirmative vote of at least 9 members; and be it further | ||||||
9 | RESOLVED, That the members of the Committee shall select a | ||||||
10 | chairperson; and be it further | ||||||
11 | RESOLVED, That the Committee shall hold public hearings and | ||||||
12 | shall study and examine issues related to prisoners sentenced | ||||||
13 | to life without parole and prisoners sentenced to terms in | ||||||
14 | excess of 30 years; and be it further | ||||||
15 | RESOLVED, That the Department of Corrections shall provide | ||||||
16 | staff and administrative support to the Committee; and be it | ||||||
17 | further | ||||||
18 | RESOLVED, That the Committee shall report its findings and | ||||||
19 | recommendations to the General Assembly in a final report which | ||||||
20 | shall be filed on or before December 31, 2007; the requirement | ||||||
21 | for reporting to the General Assembly shall be satisfied by |

1 | filing copies of the report with the Speaker, the Minority | ||||||
2 | Leader and the Clerk of the House of Representatives and the | ||||||
3 | President, the Minority Leader and the Secretary of the Senate | ||||||
4 | and the Legislative Research Unit, as required by Section 3.1 | ||||||
5 | of the General Assembly Organization Act, and filing additional | ||||||
6 | copies with the State Government Report Distribution Center for | ||||||
7 | the General Assembly as required under paragraph (t) of Section | ||||||
8 | 7 of the State Library Act; and be it further | ||||||
9 | RESOLVED, That suitable copies of this Resolution be | ||||||
10 | transmitted to the members of the Committee.
