HOUSE JOINT RESOLUTION 78

    WHEREAS, The Illinois General Assembly passed House Bill 
3
1347 on May 22, 2007; and

 
4
    WHEREAS, On August 17, 2007, House Bill 1347, having passed 
5
both the Illinois House and Senate and having been signed and 
6
approved by the Governor, became effective as Public Act 
7
95-241; and

 
8
    WHEREAS, The intent of Public Act 95-241 is to ensure that 
9
a board of education does not outsource a school district's 
10
employees to a contractor or disrupt an existing collective 
11
bargaining agreement in order to reduce wages or benefits; and

 
12
    WHEREAS, Public Act 95-241 is not intended to apply to a 
13
situation in which a board of education enters into a contract 
14
with a third party for management or consulting services where 
15
the  employees remain covered by the terms of the existing 
16
collective bargaining agreement; and

    WHEREAS, In such a situation where a board of education is 
18
contracting only for management and professional services, the 
19
school district would continue to be the employer of the 
20
employees; therefore, be it

    RESOLVED, BY THE  HOUSE OF REPRESENTATIVES OF THE 
2
NINETY-FIFTH GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, THE 
3
SENATE CONCURRING HEREIN, that it is the intent of the 
4
legislature that Public Act 95-241 does not apply to situations 
5
where a board of education contracts only for management or 
6
professional expertise and the  employees remain school 
7
district employees.
