AMENDMENT TO SENATE BILL 243

    AMENDMENT NO. ______. Amend Senate Bill 243 on page 3, by 
3
replacing lines 13 through 25 with the following:
4
    "On and after the effective date of this amendatory Act of 
5
the 95th General Assembly, no license shall be granted or 
6
renewed unless the applicant:
7
        (i) submits, and the Department approves, a plan for 
8
    providing service to Medicaid recipients and medically 
9
    underserved populations in its service area; the 
10
    Department shall adopt rules indicating the requirements 
11
    for such plans, including a definition for "medically 
12
    underserved population" and standards for minimum 
13
    proportions of Medicaid recipients and medically 
14
    underserved patients that must be served; or
15
        (ii) submits a plan for charity care that has been 
16
    approved by the Illinois Attorney General; or
17
        (iii) submits a notarized statement signed by the Chief 
18
    Executive Officer of the organization certifying that the

    applicant will not refuse service to any patient because 
2
    the services the patient seeks may be reimbursed under the 
3
    program of Medical Assistance under Article V of the 
4
    Illinois Public Aid Code.

In addition, no license shall be granted or renewed if the 
6
Department determines that the applicant has not complied with 
7
a prior plan or notarized statement submitted pursuant to this 
8
paragraph.".
