Amends the Probate Act of 1975. Provides that the term "developmental disability" includes a disability that is attributable to "fetal alcohol syndrome" or "fetal alcohol effects" (in addition to mental retardation, cerebral palsy, epilepsy, or autism). Effective January 1, 2008.

| AN ACT concerning civil law.
|
| 2 |
| Be it enacted by the People of the State of Illinois,
|
| 3 |
| represented in the General Assembly:
|
| 4 |
| Section 5. The Probate Act of 1975 is amended by changing |
| 5 |
| Section 11a-1 as follows:
|
| 6 |

| Sec. 11a-1. Developmental disability defined.) |
| 8 |
| "Developmental disability"
means a disability which is |
| 9 |
| attributable to: (a) mental retardation, cerebral
palsy, |
| 10 |
| epilepsy,
or autism, fetal alcohol syndrome, or fetal alcohol |
| 11 |
| effects; or to (b) any other condition which results in
|
| 12 |
| impairment similar to that caused by mental retardation and |
| 13 |
| which requires
services similar to those required by mentally |
| 14 |
| retarded persons. Such disability
must originate before the age |
| 15 |
| of 18 years, be expected to continue indefinitely,
and |
| 16 |
| constitute a substantial handicap.

| Section 99. Effective date. This Act takes effect January |

| 1, 2008.
