| AMENDMENT NO. ______. Amend Senate Bill 357 on page 4, line |

| 19, by replacing "it" with "subject to appropriation, the |

| Department"; and
|

| on page 7, immediately below line 7, by inserting the |
| 6 |
| following:
|

| "Section 50. Existing agreements. Notwithstanding the |
| 8 |
| provisions of Section 45 of this Act, the provisions of any |
| 9 |
| agreement entered into between the operator of an underground |
| 10 |
| aggregate mine and a unit of local government before the |
| 11 |
| effective date of this Act that concern the times during which |
| 12 |
| blasting operations are permitted within the unit of local |
| 13 |
| government shall remain in full force and effect until such |
| 14 |
| time as the agreement is mutually rescinded by the parties.".
