Amends the Code of Civil Procedure. Provides that when a plaintiff voluntarily dismisses a mortgage foreclosure action after a court found that a condominium or community association or another entity has a judgment against the defendant that is junior to the judgment entered in favor of the plaintiff, the plaintiff's voluntary dismissal of the foreclosure action shall not apply to the judgment that is junior to the plaintiff's judgment.

| Be it enacted by the People of the State of Illinois,
|
| 3 |
| represented in the General Assembly:
|

| Section 5. The Code of Civil Procedure is amended by adding |
| 5 |
| Section 15-1506.1 as follows:
|

| (735 ILCS 5/15-1506.1 new)
|

| Sec. 15-1506.1. Voluntary dismissal. When a plaintiff |
| 8 |
| voluntarily dismisses an action brought under this Article and |
| 9 |
| an order has been previously entered that includes a clause |
| 10 |
| finding that a condominium or community association or other |
| 11 |
| party has a junior judgment or judgment in second position to |
| 12 |
| that of the plaintiff, the voluntary dismissal shall not apply |
| 13 |
| to the judgment of that party.
