| Be it enacted by the People of the State of Illinois,
|
| 3 |
| represented in the General Assembly:
|

| Section 5. The Public Utilities Act is amended by changing |
| 5 |
| Section 16-124 as follows:
|

| Sec. 16-124. Metering for residential and small
commercial |
| 8 |
| retail customers.
An
An electric utility shall not require a |
| 9 |
| residential or
small commercial retail customer to take |
| 10 |
| additional metering
or metering capability as a condition of |
| 11 |
| taking delivery
services unless the Commission finds, after |
| 12 |
| notice and
hearing, that additional metering or metering |
| 13 |
| capability is
required to meet reliability requirements. |
| 14 |
| Alternative retail
electric suppliers serving such customers |
| 15 |
| may provide such
additional metering or metering capability at |
| 16 |
| their own
expense or take such additional metering or metering
|
| 17 |
| capability from the utility as a tariffed service. Any
|
| 18 |
| additional metering requirements shall be imposed in a
|
| 19 |
| nondiscriminatory manner. Nothing in this subsection shall be
|
| 20 |
| construed to prevent the normal maintenance, replacement or
|
| 21 |
| upgrade of meters as required to comply with Commission rules.
