AMENDMENT TO SENATE BILL 1926

2     AMENDMENT NO. ______. Amend Senate Bill 1926 by replacing
3 everything after the enacting clause with the following:
 
4     "Section 5. The Public Utilities Act is amended by changing
5 Section 2-203 as follows:
 
6     (220 ILCS 5/2-203)
7     (Section scheduled to be repealed on January 1, 2009)
8     Sec. 2-203. Public Utility Fund base maintenance
9 contribution. Each For each of the years 2003 through 2008,
10 each electric utility as defined in Section 16-102 of this Act
11 providing service to more than 12,500 customers in this State
12 on January 1, 1995 shall contribute annually a pro rata share
13 of a total amount of $5,500,000 based upon the number of
14 kilowatt-hours delivered to retail customers within this State
15 by each such electric utility in the 12 months preceding the
16 year of contribution. On or before May 1 of each year, the

1 Illinois Commerce Commission shall determine and notify the
2 Illinois Department of Revenue of the pro rata share owed by
3 each electric utility based upon information supplied annually
4 to the Commission. On or before June 1 of each year, the
5 Department of Revenue shall send written notification to each
6 electric utility of the amount of pro rata share they owe.
7 These contributions shall be remitted to the Department of
8 Revenue no earlier that July 1 and no later than July 31 of
9 each year the contribution is due on a return prescribed and
10 furnished by the Department of Revenue showing such information
11 as the Department of Revenue may reasonably require. The
12 Department of Revenue shall place the funds remitted under this
13 Section in the Public Utility Fund in the State treasury. The
14 funds received pursuant to this Section shall be subject to
15 appropriation by the General Assembly. If an electric utility
16 does not remit its pro rata share to the Department of Revenue,
17 the Department of Revenue must inform the Illinois Commerce
18 Commission of such failure. The Illinois Commerce Commission
19 may then revoke the certification of that electric utility.
20 This Section is repealed on January 1, 2014 2009.

22     Section 99. Effective date. This Act takes effect upon
23 becoming law.".
