Amends the Environmental Protection Act. Provides that a facility that is operated by a municipality or county is not deemed to be a waste management facility under the Act due to the fact that it is used for the cremation of deceased noncompanion animals. Effective immediately.

| AN ACT concerning environmental safety.

| Be it enacted by the People of the State of Illinois,
|
| 3 |
| represented in the General Assembly:
|
| 4 |
| Section 5. The Environmental Protection Act is amended by |
| 5 |
| changing Section 22.49 as follows:
|
| 6 |
| (415 ILCS 5/22.49)
|
| 7 |
| Sec. 22.49. Animal cremation. Unless subject to the |
| 8 |
| requirements of Title
XV of this Act as potentially infectious |
| 9 |
| medical waste, a deceased companion
animal, as defined in the |
| 10 |
| Companion Animal Cremation Act, that is delivered to
a provider |
| 11 |
| of companion animal cremation services subject to the Companion
|
| 12 |
| Animal Cremation Act is not waste for the purposes of this Act. |
| 13 |
| Providing
companion animal cremation services at a location |
| 14 |
| does not make that location a
waste management facility for the |
| 15 |
| purposes of this Act. Additionally, the cremation of deceased |
| 16 |
| animals other than companion animals does not make a facility a |
| 17 |
| waste management facility for the purposes of this Act if that |
| 18 |
| facility of operated by a municipality or county.

| 19 |
| For the purposes of this Section, "companion animal" does |
| 20 |
| not include
livestock.
