    Amends the School Code. Provides that a General Assembly scholarship must be used only for undergraduate education. Effective July 1, 2008.

1     AN ACT concerning education.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The School Code is amended by changing Sections
5 30-9 and 30-13 as follows:
 
6     (105 ILCS 5/30-9)  (from Ch. 122, par. 30-9)
7     Sec. 30-9. General Assembly scholarship; conditions of
8 admission; award by competitive examination. Each member of the
9 General Assembly may nominate annually 2 persons of school age
10 and otherwise eligible, from his district; each shall receive a
11 certificate of scholarship for undergraduate education at in
12 any State supported university designated by the member. Any
13 member of the General Assembly in making nominations under this
14 Section may designate that his nominee be granted a 4 year
15 scholarship or may instead designate 2 or 4 nominees for that
16 particular scholarship, each to receive a 2 year or a one year
17 scholarship, respectively. The nominee, if a graduate of a
18 school accredited by the University to which nominated, shall
19 be admitted to the university on the same conditions as to
20 educational qualifications as are other graduates of
21 accredited schools. If the nominee is not a graduate of a
22 school accredited by the university to which nominated, he
23 must, before being entitled to the benefits of the scholarship,

1 pass an examination given by the superintendent of schools of
2 the county where he resides at the time stated in Section 30-7
3 for the competitive examination. The president of each
4 university shall prescribe the rules governing the examination
5 for scholarship to his university.
6     A member of the General Assembly may award the scholarship
7 by competitive examination conducted under like rules as
8 prescribed in Section 30-7 even though one or more of the
9 applicants are graduates of schools accredited by the
10 university.
11     A member of the General Assembly may delegate to the
12 Illinois Student Assistance Commission the authority to
13 nominate persons for General Assembly scholarships which that
14 member would otherwise be entitled to award, or may direct the
15 Commission to evaluate and make recommendations to the member
16 concerning candidates for such scholarships. In the event a
17 member delegates his nominating authority or directs the
18 Commission to evaluate and make recommendations concerning
19 candidates for General Assembly scholarships, the member shall
20 inform the Commission in writing of the criteria which he
21 wishes the Commission to apply in nominating or recommending
22 candidates. Those criteria may include some or all of the
23 criteria provided in Section 25 of the Higher Education Student
24 Assistance Act. A delegation of authority under this paragraph
25 may be revoked at any time by the member.
26     Failure of a member of the General Assembly to make a

1 nomination in any year shall not cause that scholarship to
2 lapse, but the member may make a nomination for such
3 scholarship at any time thereafter before the expiration of his
4 term, and the person so nominated shall be entitled to the same
5 benefits as holders of other scholarships provided herein. Any
6 such scholarship for which a member has made no nomination
7 prior to the expiration of the term for which he was elected
8 shall lapse upon the expiration of that term.

11     Sec. 30-13. The scholarships issued under Sections 30-9
12 through 30-12 of this Article may be used at the University of
13 Illinois, Southern Illinois University, Chicago State
14 University, Eastern Illinois University, Governors State
15 University, Illinois State University, Northeastern Illinois
16 University, Northern Illinois University, and Western Illinois
17 University as provided in those sections. Unless otherwise
18 indicated, these scholarships shall be good for a period of not
19 more than 4 years while enrolled for undergraduate residence
20 credit and shall exempt the holder from the payment of tuition,
21 or any matriculation, graduation, activity, term or incidental
22 fee, except any portion of a multipurpose fee which is used for
23 a purpose for which exemption is not granted under this
24 Section. Exemption shall not be granted from any other fees,
25 including book rental, service, laboratory, supply, union

1 building, hospital and medical insurance fees and any fees
2 established for the operation and maintenance of buildings, the
3 income of which is pledged to the payment of interest and
4 principal on bonds issued by the governing board of any
5 university or community college.
6     Any student who has been or shall be awarded a scholarship
7 shall be reimbursed by the appropriate university or community
8 college for any fees which he has paid and for which exemption
9 is granted under this Section, if application for such
10 reimbursement is made within 2 months following the school term
11 for which the fees were paid.
12     The holder of a scholarship shall be subject to all
13 examinations, rules and requirements of the university or
14 community college in which he is enrolled except as herein
15 directed.
16     This article does not prohibit the Board of Trustees of the
17 University of Illinois, the Board of Trustees of Southern
18 Illinois University, the Board of Regents of the Regency
19 Universities System and the Board of Governors of State
20 Colleges and Universities for the institutions under their
21 respective jurisdictions from granting other scholarships.

23     Section 99. Effective date. This Act takes effect July 1,
