    AN ACT concerning fish.

    Be it enacted by the People of the State of Illinois,
 
3
represented in the General Assembly:

    Section 5. The Fish and Aquatic Life Code is amended  by 
5
adding Section 20-82 as follows:

    (515 ILCS 5/20-82  new)

    Sec. 20-82. Asian Carp Reduction Pilot Program.
8
    (a) Subject to appropriation, the Department of Natural 
9
Resources shall establish a one-year pilot program to stimulate 
10
the bulk harvest of Bighead Carp (hypophthalmichthys noblis) 
11
and Silver Carp (hypophthalmichthys molitrix) in the Illinois 
12
River and to increase the number of native fish.
13
    (b) The General Assembly may appropriate an amount not to 
14
exceed $3,000,000 to the Department of Natural Resources for 
15
the purposes of this pilot program. From the amounts 
16
appropriated, the Department may enter into contracts with 
17
licensed commercial fishermen and other organizations for the 
18
administration, staffing, materials, and equipment necessary 
19
for the program, and the Department may also use appropriated 
20
funds to establish grants to natural resource conservation 
21
organizations that serve the Illinois River basin for the 
22
purposes of this program.

    (c) The pilot program shall include the development of a

scientific plan to reduce or remove Bighead Carp and Silver 
2
Carp from the river system.

    (d) The Department shall issue a report with the results of 
4
the Asian Carp Reduction Pilot Program to the General Assembly 
5
no later than December 31, 2009.

    (e) This Section is repealed on January 1, 2010.

    Section 99. Effective date. This Act takes effect upon 
8
becoming law.
