| AMENDMENT NO. ______. Amend Senate Bill 2506 on page 2, |

| line 11, after the period, by inserting the following: "If the |
| 4 |
| Director requires a facility to use the amount of a penalty for |
| 5 |
| the purpose of implementing a directed plan of correction as |
| 6 |
| provided in this subsection, it is the Department's |
| 7 |
| responsibility to ensure that the facility in fact uses the |
| 8 |
| amount of the penalty for that purpose.".
