AMENDMENT TO SENATE BILL 2567

    AMENDMENT NO. ______. Amend Senate Bill 2567, AS AMENDED, 
3
with reference to page and line numbers of Senate Amendment No. 
4
1, on page 2, by replacing lines 24 through 26 with "with 12 
5
inches of soil, within 30 days after the final placement and 
6
completion of the structural fill project or within 120 days of 
7
the last placement of the structural fill in cases where 
8
filling is incomplete and no filling takes place for a period 
9
of 90 days,"; and

on page 3, by replacing lines 7 through 12 with the following:
11
    "For each project utilizing 10,000 tons or more of CCB, 
12
within 30 days after the placement of the 12 inches of cover 
13
soil required under this item (8), the person using the CCB as 
14
structural fill must submit to the Agency a certification 
15
demonstrating that the use meets the requirements of this 
16
Section.  The certification shall also include the information 
17
required to be submitted to the Agency under item (C) of

subsection (a-5) of this Section.  The certification must be 
2
submitted on forms and in a format prescribed by the Agency and 
3
must be certified by a licensed professional engineer.  For the 
4
purposes of this subsection, "licensed professional engineer" 
5
means a licensed professional engineer as defined in Section 
6
58.2 of this Act."; and
 
7
on page 6, by replacing lines 15 and 16 with "CCB during the 
8
effective period of the approval and any extension of the 
9
approval,"; and
 
10
on page 6, by replacing lines 18 and 19 with "conditions."; and
 
11
on page 7, by replacing lines 12 through 25 with the following:

"determinations in accordance with this subsection (b).  No 
13
later than January 31, 2009, the Agency shall propose to the 
14
Board, and, no later than January 31, 2010, the Board must 
15
adopt rules concerning the use of CCB under item (8) of 
16
subsection (a).  These rules must include specific rules for the 
17
use of CCB as structural fill.".
