1     AN ACT concerning local government.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Regional Transportation Authority Act is
5 amended by changing Section 1.05 as follows:
 
6     (70 ILCS 3615/1.05)  (from Ch. 111 2/3, par. 701.05)
7     Sec. 1.05. Referendum on Establishment. A special
8 referendum election shall be held at which there shall be
9 submitted to the the electors in the metropolitan region the
10 proposition to approve creation of the Authority, which
11 proposition shall be in substantially the following form:
12     Shall a Regional Transportation Authority be created for
13 Cook, DuPage, Kane, Lake, McHenry and Will Counties, Illinois?
14     The special referendum election shall be conducted by the
15 County Clerks and Boards of Election Commissioners in the
16 metropolitan region pursuant to the provisions of "The Election
17 Code", approved May 11, 1943, as amended, except as is
18 specifically provided otherwise in this Section. The special
19 referendum election shall be held at the same time and with the
20 same judges, polling places and precincts as for the regular
21 primary elections to be held on March 19, 1974, in the
22 metropolitan region.
23     The proposition shall be submitted to the electors on a

1 separate paper ballot to be printed on blue paper. The State
2 Board of Elections shall prepare and certify the form of ballot
3 to the County Clerks and Boards of Election Commissioners in
4 the metropolitan region.
5     Notice of the referendum election shall be given by the
6 State Board of Elections. In addition, such notice may be given
7 by the County Clerks and Boards of Election Commissioners. Each
8 notice of the special election shall set forth the proposition
9 to be voted upon, the date of the election and the time the
10 polling places will be open and shall state that the polling
11 places and precincts for such election shall be the same as for
12 the primary elections held on such date. The notice given by
13 the State Board of Elections shall be published in one or more
14 daily newspapers of general circulation in the metropolitan
15 region at least once not less than 20 days prior to the
16 election. Notice of the special referendum election need not
17 set forth the precincts or polling places in detail. Notices
18 given by County Clerks or Boards of Election Commissioners
19 shall be in the form prescribed by the State Board of
20 Elections.
21     The votes shall be canvassed and returned in the manner
22 provided for public measures submitted to the electors of the
23 entire State, including the provisions for tally sheets,
24 certificates of results, canvassing and abstracts of votes.
25 Only those ballots properly marked yes or no shall be counted
26 in the referendum. Each municipal Board of Election

1 Commissioners shall make its return to the County Clerk of the
2 County in which it is located; the County Clerks and any County
3 Board of Election Commissioners shall each make returns
4 covering their entire county to the State Board of Elections.
5 Each County Clerk and Board of Election Commissioners shall
6 prepare and certify an abstract of votes cast on the
7 proposition in the precincts within its election jurisdiction.
8 The County Clerks and any county Board of Election
9 Commissioners shall transmit the certified abstracts to the
10 State Board of Elections with its return within 10 days of the
11 referendum. To meet this deadline, the County Clerks and Boards
12 of Election Commissioners shall canvass the votes cast in the
13 special referendum election prior to canvassing the votes cast
14 for any office in the regular primary election, and may certify
15 the results of and make returns on the special referendum
16 election prior to completing those procedures for the regular
17 primary elections.
18     The State Board of Elections shall proclaim and certify the
19 results of the referendum election. If a majority of those
20 electors properly marking ballots on the proposition vote in
21 favor of the creation of the Authority, such Authority shall
22 thereby be established.
