1 SENATE RESOLUTION

2 WHEREAS, Public Act 92-873 was enacted in 2003 to create

3 the Elevator Safety and Regulation Act; and

4 WHEREAS, The purpose of the Elevator Safety and Regulation

5 Act is to provide public safety of life and limb and to promote

6 public safety awareness; and

7 WHEREAS, When Public Act 92-873 was enacted, it created the

8 Elevator Safety Review Board; and

9 WHEREAS, Municipal building departments have always played

10 a major role in the elevator safety and inspection process; and

11 WHEREAS, The General Assembly felt municipalities played

12 such an important role in elevator safety that three municipal

13 positions were included on the Elevator Safety Review Board;

14 and

15 WHEREAS, The Governor has appointed individuals to these

16 municipal positions who do not represent or have any

17 affiliation with local municipal governments; and

18 WHEREAS, One of these individuals who has been appointed to

19 a municipal position on the Board, but who has no municipal

1 affiliation, has also been appointed Chairman of the Elevator

2 Safety Review Board; and

3 WHEREAS, Because of these appointments, there has been no

4 input from municipalities in the administration of the Elevator

5 Safety and Regulation Act, which goes against the intent of the

6 Act; and

7 WHEREAS, The above mentioned appointments and lack of

8 municipal representation violate the legislative intent of the

9 Elevator Safety and Regulation Act; therefore, be it

10 RESOLVED, BY THE SENATE OF THE NINETY-FIFTH GENERAL

11 ASSEMBLY OF THE STATE OF ILLINOIS, that we urge the Governor to

12 follow the intent of the Elevator Safety and Regulation Act and

13 appoint individuals who truly represent municipalities to the

14 three municipal positions on the Elevator Safety Review Board;

15 and be it further

16 RESOLVED, That a copy of this resolution be delivered to

17 Governor Rod Blagojevich.
