Synopsis As Introduced
Amends the Criminal Code of 1961. Provides that, except as otherwise provided in the Code, a prosecution for any offense involving sexual conduct or sexual penetration where the victim and defendant are family members may be commenced within 10 years (rather than one year) of the victim attaining the age of 18 years. Provides that for the purposes of the offenses of criminal sexual assault, aggravated criminal sexual assault, predatory criminal sexual assault of a child, criminal sexual abuse, and aggravated criminal sexual abuse, "family member" includes a brother, sister, aunt, uncle, great-aunt, great-uncle, niece, nephew, cousin of the first degree, step-brother, or step-sister, and where the victim is a child under 18 years of age, an accused who has resided in the household with such child continuously for at least 6 months (rather than one year).

720 ILCS 5/11-11from Ch. 38, par. 11-11

Eliminates the provision that a prosecution for any offense involving sexual conduct or sexual penetration where the victim and defendant are family members may be commenced within one year of the victim attaining the age of 18 years. Provides that the offense of sexual relations within families includes sexual penetration with (1) an aunt or uncle, when the niece or nephew was 18 years of age or over when the act was committed; or (2) a great-aunt or great-uncle, when the grand-niece or grand-nephew was 18 years of age or over when the act was committed; or (3) a grandparent or step-grandparent, when the grandchild or step-grandchild was 18 years of age or over when the act was committed. Provides that a prosecution for felony criminal sexual abuse when the victim was under 18 years of age at the time of the offense may be commenced within 20 years after the victim attains 18 years of age and for misdemeanor criminal sexual abuse within 10 years after the victim attains 18 years of age. Deletes from expanded definition of "family member" the following: "brother, sister", "step-brother, step-sister", "niece, nephew", and "cousin of the first degree".
