Synopsis As Introduced
Amends the Riverboat Gambling Act. Provides that applications for owners licenses shall be considered in accordance with the rules of the Illinois Gaming Board (deleting statutory deadlines for filing the applications). Makes changes in provisions concerning the determining factors in the Board's decision in granting owners licenses. Makes changes concerning the criteria for an occupational license. Provides that excursion cruises shall not exceed 4 hours for a round trip, but that the Board may grant express approval for an extended cruise on a case-by-case basis. Provides exceptions to the requirement that gambling equipment and supplies must be purchased or leased only from suppliers licensed under the Act. Provides that any winnings that are a result of a wager by a person under age 21 shall be treated as winnings for privilege tax purposes, confiscated, and forfeited to the State and deposited into the Education Assistance Fund. Provides that the privilege tax shall be paid to the Board not later than 5:00 (was 3:00) o'clock p.m. of the day after the day when the wagers were made. Requires that, within 90 days after the end of each quarter of each fiscal year, the licensed owner or manager shall transmit to the Board a compliance report on engagement procedures determined by the Board. Provides that a person under the age of 21 who enters upon a riverboat commits a petty offense and is subject to a fine. Makes changes concerning admission taxes. Makes other changes. Effective immediately.

Replaces everything after the enacting clause with the introduced bill with the following changes. Amends the Department of Revenue Law of the Civil Administrative Code of Illinois and the Riverboat Gambling Act. Separates the Illinois Gaming Board from the Department of Revenue for the purposes of enforcing and administering the Riverboat Gambling Act. Makes conforming changes. Prohibits members of the Board from holding any other public office (rather than any other public office for which he or she shall receive compensation) and from engaging in any political activity. Provides for an annual salary for Board members. Makes changes regarding disclosure of equity interests of the Board members and their spouses and children. In provisions concerning the powers and duties of the Board, removes language allowing the Director of Revenue to delegate responsibility for the administration and enforcement of certain Acts concerning gaming to the Board and adds language concerning appointing investigators and contracting with the Departments of State Police and Revenue for the use of investigators. Makes changes concerning appropriations from the State Gaming Fund. Amends the Executive Reorganization Implementation Act. Excludes the Illinois Gaming Board from the definition of "agency directly responsible to the Governor". Amends the Illinois Pension Code. In the State Employees Article, adds investigators for the Illinois Gaming Board to provisions concerning the alternative formula. Exempts the changes from provisions concerning new benefit increases. In the Judges Article, allows a participant who, on January 1, 2007, is serving on the Illinois Gaming Board to continue to receive benefits despite that service. Exempts the changes from provisions concerning new benefit increases. Makes other changes. Effective July 1, 2009.

House Floor Amendment No. 2

In provisions concerning the admission tax, removes provisions setting the rate at $3 per person admitted for all owners licensees, but specifies that the admission tax rate for licensees that were not conducting gambling operations in 2004 is $3 per person admitted. Removes provisions amending the Riverboat Gambling Act that require the Illinois Gaming Board to compute its total estimated costs for the forthcoming State fiscal year and make owners licensees liable for assessments that fully cover the Board's total estimated costs.

Senate Committee Amendment No. 1
Further amends the Department of Revenue Law of the Civil Administrative Code of Illinois. Provides that the Department's investigators have expanded powers of peace officers to enforce taxing and other measures related to liquor, racing, and gaming. The investigators may exercise the powers if there is a threat to life or safety and local law enforcement is notified as soon as practical.

Senate Committee Amendment No. 2
Further amends the Riverboat Gambling Act. Provides that, if the licensed owner of a riverboat in operation on January 1, 2009 has capital projects of at least $45,000,000 that are approved by the Illinois Gaming Board in calendar years 2006 through 2009 or for which at least $45,000,000 in expenditures have been made in calendar years 2006 through 2009, then no admissions tax is imposed on admissions to that riverboat. Provides that, if no admissions tax is imposed on admissions to a riverboat, then in addition to the current privilege tax, a privilege tax of 1% of adjusted gross receipts is imposed on that riverboat, the proceeds of which shall be paid monthly to the unit of local government that is designated as the home dock of the riverboat upon which those riverboat gambling operations are conducted.

Senate Committee Amendment No. 3
Removes provisions authorizing an annual salary for members of the Illinois Gaming Board. Restores language allowing a Board member to receive $300 for each day the Board meets and for each day the member conducts any hearing pursuant to the Riverboat Gambling Act.

Senate Floor Amendment No. 4
Provides that, if the licensed owner of a riverboat in operation on January 1, 2009 has capital projects of at least $45,000,000 that are approved by the Board after January 1, 2006 (rather than in calendar years 2006 through 2009) or for which at least $45,000,000 in capital expenditures (rather than expenditures) have been made after January 1, 2006 (rather than in calendar years 2006 through 2009), then no admissions tax is imposed on admissions to that riverboat (and the privilege tax is increased by 1% of adjusted gross receipts).
