Synopsis As Introduced
Amends the Illinois State Auditing Act. Provides for the establishment and operation within the Office of the Auditor General of an Appropriations Earmark Unit to conduct performance audits of earmarked appropriations that become law. Requires operation of a telephone hot line to receive anonymous suggestions for audits of grant programs and earmarked appropriations. Requires the audits to be public records and filed with the Legislative Audit Commission. Requires a majority vote of the Commission in order to direct the Auditor General to cease conducting an audit. Effective July 1, 2009.

House Committee Amendment No. 1
Deletes everything after the enacting clause. Reinserts the provisions of the bill with the following changes: Redefines "earmarked appropriation" to include grants and distributions from a lump sum appropriation. Defines "operating expenses". Authorizes the Unit to review, as well as audit, earmarked appropriations. Requires executive and legislative branch State agencies to report earmarked appropriations to the Unit, and requires the Unit to review the distribution and use of a sample of those reported. Authorizes the Auditor General to refer earmarked appropriations to the distributing State agencies for review. Authorizes the Legislative Audit Commission to direct the Auditor General to audit an earmarked appropriation. Effective July 1, 2009.

Replaces everything after the enacting clause. Amends the General Obligation Bond Act. Increases bonding authority by $3,000,000,000. Allocates $2,000,000,000 for Transportation A bonds (roads and bridges) for use statewide and $1,000,000,000 for Transportation B bonds (rail and mass transit) for use statewide. Effective immediately.

Senate Floor Amendment No. 3
Replaces everything after the enacting clause. Amends the General Obligation Bond Act if and only if House Bill 210 becomes law. Increases bonding authority by $3,000,000,000. Allocates $2,000,000,000 for Transportation A bonds (roads and bridges) for use on projects included in the FY09-14 Proposed Highway Improvement Program as published by the Illinois Department of Transportation in May 2008 (these projects shall reflect the generally accepted historical distribution of projects throughout the State) and $1,000,000,000 for Transportation B bonds (rail and mass transit) for use on projects that shall reflect the generally accepted historical distribution of projects throughout the State. Effective immediately.

Senate Floor Amendment No. 4
Provides that the $2,000,000,000 increase in Transportation B bonds shall be used on projects included in either (i) the FY09-14 Proposed Highway Improvement Program as published by the Illinois Department of Transportation in May 2008 or (ii) the FY10-15 Proposed Highway Improvement Program to be published by the Illinois Department of Transportation in the spring of 2009; except that all projects must be maintenance projects for the existing State system with the goal of reaching 90% acceptable condition in the system statewide and further except that all projects must reflect the generally accepted historical distribution of projects throughout the State.
