Synopsis As Introduced
Amends the Illinois Vehicle Code. Provides that, in addition to the 8 previously designated counties, the counties of Champaign, DeKalb, La Salle, McLean, Peoria, Sangamon, Vermilion, and Winnebago, and the municipalities within those counties, may establish an automated traffic law enforcement system with one or more motor vehicle sensors working in conjunction with a red light signal to produce recorded images of motor vehicles entering an intersection against a red signal indication. Effective immediately.

House Floor Amendment No. 6
Adds Macon and deletes Champaign, La Salle, Vermillion, Peoria, and Sangamon to the list of counties where automated traffic law enforcement systems may be established by municipalities.

Senate Committee Amendment No. 1
Adds reference to:
625 ILCS 5/11-612

Deletes everything after the enacting clause. Amends the Illinois Vehicle Code. Expands the definition of "automated traffic law enforcement system" from a device with one or more motor vehicle sensors working in conjunction with a red light signal to produce recorded images of motor vehicles entering an intersection against a red signal indication in violation of the Illinois Vehicle Code or similar local ordinance to also include a device used in a school zone, park district, or hospital district, as determined by the unit of local government, that produces a recorded image of a motor vehicle and the vehicle's registration plate while the driver is operating a motor vehicle in violation of the Illinois Vehicle Code or similar local ordinance. Provides the same provisions as before the expansion of the definition for civil penalties, administrative adjudication, and driver notice, among other provisions. Provides that "an automated traffic law enforcement system shall utilize in-ground and above-ground detection technology to accurately capture violations. Adds Macon and Winnebago to the counties and municipalities within those counties that are authorized to use automated traffic law systems used to capture red light violations. Provides that automated traffic law systems used to capture speed are authorized in the counties of Cook, DuPage, Kane, Lake, Macon, McHenry, Will, and Winnebago and municipalities located within those counties. Reduces the application of a home rule preemption and eliminates a similar preemption that disallows the use of recorded images to capture the speed of a motor vehicle for the purposes of enforcing any law or local ordinance regarding a minimum or maximum speed limit unless a law enforcement officer is present to witness the event. Effective January 1, 2010.

Senate Committee Amendment No. 2
In a provision describing State-authorized speed detection technology, provides that a governmental entity may utilize fixed cameras with in-ground detection technology rather than fixed or non-fixed cameras with in-ground or above-ground detection technology.
