Synopsis As Introduced
Amends the Criminal Code of 1961. Expands the statute concerning interference with a public institution of higher education to also include interference with public elementary and secondary schools. Provides that if the interference with the public institution of education is accompanied by a threat, the person commits a Class 3 felony and may be sentenced to a term of imprisonment of not less than 2 years and not more than 10 years and may be prosecuted for intimidation.

House Floor Amendment No. 1
Provides that interference with the public institution of education accompanied by a threat of personal injury or property damage is a Class 3 felony.

Governor Amendatory Veto Message
Recommends: making interference with a public institution of education accompanied by a threat of personal injury or property damage a Class 4 (rather than Class 3) felony punishable by imprisonment of not less than one year (rather than 2 years) and not more than 6 years (rather than 10 years); and removing language providing that a person committing the offense may be prosecuted for intimidation.
