Synopsis As Introduced
Amends the Illinois Public Aid Code. In connection with provisions for a State claim against the estate of medical assistance recipients, deletes a provision that the amount expended (1) for a person of any age who is an inpatient in a nursing facility, an intermediate care facility for the mentally retarded, or other medical institution, or (2) for a person aged 55 or more, shall be a claim against the estate of the person's spouse. Effective immediately.

Replaces everything after the enacting clause. Amends the Disabilities Services Act of 2003. Adds provisions for a Rapid Reintegration Pilot Program, to be operated by the Department of Human Services, to demonstrate that, with appropriate support and services, individuals with physical disabilities and individuals with mental illness who need a short-term placement of 6 months or less in a nursing facility can successfully return to the community without experiencing unnecessary institutionalization. Provides that the pilot program shall operate for not less than 3 years after the effective date of the amendatory Act. Provides that the pilot program does not apply to facilities that qualify under federal law as institutions for mental disease. Effective immediately.

Governor Amendatory Veto Message
Recommends that the Department of Human Services (DHS) and the Department on Aging (instead of only DHS) shall operate the Rapid Reintegration Pilot Program. Recommends making operation of the pilot program subject to appropriation and including individuals age 65 and older in the program. Recommends expansion of the pilot program "after completion of a successful evaluation". Recommends the involvement of the Department on Aging in securing the cooperation of hospitals. Recommends the involvement of Case Coordination Units and area agencies on aging. Recommends that operation and other features of the pilot program be subject to appropriation. Recommends that the Department of Healthcare and Family Services, in collaboration with DHS and the Department on Aging, shall assess the effectiveness of the pilot program (instead of providing for an assessment by DHS). Recommends other changes.
