Synopsis As Introduced
Amends the Counties Code. Makes a technical change in a Section concerning powers of counties.

Deletes everything after the enacting clause. Amends the Counties Code. In a Section concerning the regulation of food establishments by the county board of any county having a population of 1,000,000 or more, changes the scope of the authorization from "food service establishments" to "retail food establishments". Adds that a county board may impose inspection fees on retail food establishments in the county. Provides that a county and a municipality may enter into an intergovernmental agreement for the county's certified local health department to perform any and all retail food inspections for the municipality. Makes other changes. Amends the Illinois Municipal Code. Requires a municipality to regulate and inspect retail food establishments in the municipality. Authorizes a municipality to enter into an intergovernmental agreement with a county for the county's certified local health department to perform any and all retail food inspections for the municipality. Limits home rule powers. Amends the State Mandates Act to require implementation without reimbursement.

House Floor Amendment No. 2
Deletes everything after the enacting clause. Reinserts the provisions of the bill as amended by House Amendment No. 1 with changes. Deletes a provision authorizing a county board to impose inspection fees on retail food establishments in the county. Deletes provisions providing that an intergovernmental agreement entered into by a county and a municipality shall not preclude a municipality from continuing to impose inspection fees within its jurisdiction. Requires a municipality in "a county having a population of 1,000,000 or more inhabitants" to regulate and inspect specified retail food establishments. Exempts from the regulation and inspection requirements a municipality that is served by a certified local health department other than a county certified local health department.

Senate Committee Amendment No. 2
Deletes everything after the enacting clause. Reinserts the engrossed bill with changes. Provides that a county board with 2,000,000 inhabitants (instead of 1,000,000) may license and regulate retail food establishments. Requires a municipality in a county having a population of 2,000,000 or more inhabitants (instead of 1,000,000) to regulate and inspect specified retail food establishments.
