Synopsis As Introduced
Amends the State Employees Group Insurance Act of 1971, the Illinois Insurance Code, and the Health Maintenance Organization Act. Provides that a policy or plan that provides coverage for hospital or medical treatment on an expense-incurred basis, may offer wellness coverage that allows for a reward, a health spending account contribution, a reduction in premiums or reduced medical, prescription drug or equipment copayments, coinsurance, or deductibles, or a combination of these incentives. Provides that "wellness coverage" means health care coverage with the primary purpose to engage and motivate the insured or enrollee through: incentives; provision of health education, counseling, and self-management skills; identification of modifiable health risks; and other activities to influence health behavior changes. Provides that the insured or enrollee may be required to provide evidence of participation in a program, or demonstrative compliance with treatment recommendations as determined by the health insurer or managed care plan. Sets forth requirements concerning (1) opportunities for participants to qualify for incentives, (2) alternatives for participants to satisfy applicable wellness program standards where it is unreasonably difficult due to the participant's medical condition, and (3) the ratio of the total incentive monetary amount to the cost of employee-only coverage. Imposes conditions on any rulemaking authority. Makes other changes. Effective January 1, 2010.

 Fiscal Note (Dept. of Healthcare & Family Services)
 Costs in implementing wellness programs through the various health plans under SEGIA could vary widely. Any direct costs would be a function of what incentives, if any, the State elected to offer (i.e., reduced copays or deductibles). These costs, in turn, would be offset by savings resulting from reduced utilization and liabilities. Savings would be dependent on what wellness programs are offered, the participation level, and whether participation would be voluntary or mandatory. Generally speaking however, wellness programs often require an investment in programs at the beginning of implementation. Savings from the programs are not often realized immediately. The savings are generally based upon the overall health of the group and usually take some time to accrue. Thus, depending on the structure of a wellness program, a short term negative impact to programmatic cash flows would occur.

 HB 927 has no projected fiscal impact to the Illinois Department of Financial and Professional Regulation.

Senate Committee Amendment No. 1
Provides that individuals who are unable to participate in incentives due to an adverse health factor shall not be penalized based upon an adverse health status. Sets forth a definition of "reasonably designed program". Deletes a provision concerning rulemaking authority.

Senate Floor Amendment No. 2
Deletes references to health spending accounts. Deletes language that provides that the insured or enrollee may be required to provide evidence of demonstrative compliance with treatment recommendations as determined by the health insurer or managed care plan.

Governor Amendatory Veto Message
Recommends adding language amending the Department of Public Health Powers and Duties Law of the Civil Administrative Code of Illinois by creating the Office of the Public Health Advocate, to be headed by a Public Health Advocate appointed by the Governor, within the Department of Public Health to provide specified information and assistance to consumers.
