Synopsis As Introduced
Amends the School Code. Provides that a school district must not be certified by the State Board of Education to be in financial difficulty as a result of the failure of the Comptroller to disburse certain School Code reimbursements for receipt by the school district no later than June 30th of each year. Effective July 1, 2009.

House Committee Amendment No. 1
Deletes everything after the enacting clause. Amends the School Code. Provides that a school district must not be certified by the State Board of Education to be in financial difficulty solely by reason of (instead of just by reason of) any of certain circumstances arising as a result of the failure of the county to make any distribution of property tax money due the district at the time the distribution is due. Also includes as a result the failure of this State to make timely payments of general State aid or any of the mandated categoricals. Provides that any financial profile compiled and distributed (instead of any financial watch list distributed) by the State Board of Education shall incorporate appropriate adjustments to the various profile scores for any year impacted by (instead of designate those school districts on the watch list that would not otherwise be on the watch list were it not for) the inability or refusal of this State to make timely disbursements of any general State aid or mandated categorical aid payments (instead of just any payments) due school districts or to fully reimburse school districts for mandated categorical programs. Effective July 1, 2009.

Senate Floor Amendment No. 1
Deletes everything after the enacting clause. Reinserts the contents of the bill as engrossed with the following changes. Provides that any financial profile compiled and distributed by the State Board of Education in Fiscal Year 2009 or any fiscal year thereafter shall incorporate such adjustments as may be needed in the profile scores to reflect the financial effects of (instead of any financial profile compiled and distributed by the State Board of Education shall incorporate appropriate adjustments to the various profile scores for any year impacted by) the inability or refusal of the State to make timely disbursements of any general State aid or mandated categorical aid payments due school districts or to fully reimburse school districts for mandated categorical programs pursuant to reimbursement formulas provided in the School Code. Effective July 1, 2009.
