Synopsis As Introduced
Amends the Code of Civil Procedure. Provides that in a foreclosure action while the municipality within which the property is located shall not be joined as a party unless joined under other provisions of the Code, the municipality shall be added to the service list in the foreclosure action and all parties shall provide the clerk of the municipality with a copy of any document or notice filed in the foreclosure action. Effective immediately.

House Committee Amendment No. 1
Replaces everything after the enacting clause with provisions that are similar to the provisions of the bill as introduced except that it provides that: while the municipality within the boundaries of which the property is located, or the township, if the area is unincorporated, shall not be joined as a party unless it is joined as a party under the Act; and the municipality or township shall be provided a copy of the recorded notice of foreclosure, which shall be sent, within 15 days after it is recorded, by first class mail to the municipal or township clerk. Provides that the notice of foreclosure shall include: the names of all plaintiffs and the case number; the court in which the action was brought; the names, addresses, phone numbers and other known contact information of title holders of record (instead of the names of title holders of record); a legal description of the real estate sufficient to identify it with reasonable certainty; a common address or description of the location of the real estate; and identification of the mortgage sought to be foreclosed. Effective immediately.
