Synopsis As Introduced
Amends the Illinois Vehicle Code. Makes a technical change in a Section concerning certificates of title.

625 ILCS 5/4-203from Ch. 95 1/2, par. 4-203

Replaces everything after the enacting clause. Amends the Illinois Vehicle Code. Restores language making personal property in a vehicle removed under specified circumstances by a commercial vehicle relocator or other towing service subject to a lien with specified exceptions (the language had been deleted by Public Act 96-1274). Adds exceptions to the lien for: child restraint systems or booster seats; eyeglasses; and personal property belonging to a person other than the vehicle owner. Provides that exempted personal property may be claimed by the vehicle owner (or the spouse, child, mother, father, brother, or sister of the vehicle owner with the authorization of the vehicle owner). Provides that, in the case of a vehicle that is towed as a result of being involved in an accident, any personal property in a vehicle is exempt from the lien and may be claimed by the vehicle owner (or the spouse, child, mother, father, brother, or sister of the vehicle owner with the authorization of the vehicle owner) upon showing proof that the vehicle owner has an insurance policy covering towing and storage fees. Preempts home rule. Effective January 1, 2011.
