Synopsis As Introduced
Amends the Use of Intoxicating Compounds Act. Increases the penalties for a second or subsequent violation of the Act in which another penalty is not otherwise provided from a Class C misdemeanor to a Class A misdemeanor.

House Floor Amendment No. 1
Adds reference to:
20 ILCS 301/40-5

Amends the Alcoholism and Other Drug Abuse and Dependency Act. Provides that a person charged with or convicted of a Class C misdemeanor violation of the Use of Intoxicating Compounds Act may elect treatment under the Act.

Senate Floor Amendment No. 1
Provides that a person charged with or convicted of a misdemeanor violation (rather than a Class C misdemeanor violation) of the Use of Intoxicating Compounds Act and who has not been previously convicted of a violation of that Act may elect treatment under the Alcoholism and Other Drug Abuse and Dependency Act.
