Synopsis As Introduced
Amends the Department of Professional Regulation Law of the Civil Administrative Code of Illinois. Provides that any licensee disciplined under a licensure Act administered by the Division of Professional Regulation for an offense relating to the failure to pay taxes, child support, or student loans or relating to continuing education or advertising may file a petition with the Department on forms provided by the Department, along with the required fee of $200, to have the records of that offense removed from public view on the Department's website if certain conditions are met. Provides that nothing shall prohibit the Department from using a previous discipline for any regulatory purpose or from releasing records of a previous discipline upon request from law enforcement, other governmental body, or the public. Provides that removal of records of a disciplinary offense from the Department's website shall not be considered a vacating or expunging of the offense from the licensee's disciplinary record. Effective immediately.

Adds reference to:
410 ILCS 517/51 new

Replaces everything after the enacting clause. Amends the Department of Professional Regulation Law of the Civil Administrative Code of Illinois. Provides that any licensee subject to a licensing Act administered by the Division of Professional Regulation and who has been subject to disciplinary action by the Department may file an application with the Department on forms provided by the Department, along with the required fee of $200, to have the records classified as confidential, not for public release and considered expunged for reporting purposes if certain conditions are met. Provides that an application to make disciplinary records confidential shall only be considered by the Department for an offense or action relating to certain specified violations or provisions. Provides that the Department may establish additional requirements by rule. Provides that the Department is not required to report the removal of any disciplinary record to any national database. Makes other changes. Amends the Health Care Professional Credentials Data Collection Act. Provides that licensure records designated confidential and considered expunged for reporting purposes by the licensee under the Civil Administrative Code are not reportable under the Act. Effective immediately.
