Synopsis As Introduced
Amends the Animal Welfare Act and the State Finance Act to create the Animal Welfare Fund as a special fund in the State Treasury. Requires all fees and other money received by the Department of Agriculture under the Animal Welfare Act to be deposited into the Fund. Subject to appropriation, requires moneys in the Animal Welfare Fund to be used by the Department for the purpose of enforcing the Animal Welfare Act. Effective immediately.

 This bill does pre-empt home rule authority.

 Fiscal Note (Dept. of Agriculture)
 The fiscal impact to the Department of Agriculture as a result of HB 5300's provisions would be as follows: Revenues - $20,000 was generated in FY09 from citations imposed on licensees. Thus far in FY10, $12,000 has been collected. Licensing fees in FY09 generated $102,000. Expenditures - The administration of the licensing program requires 0.5 FTE clerical staff. At the present time, there is 6 full time field staff that inspect licensees and enforce the AWA. There is one administrator and one clerical staff member in support of the field staff. The operation costs for the Animal Welfare program of the Bureau of Animal Health and Welfare is over $700,000.00. The fees generated from this fund alone would not be sufficient for the Bureau of Animal Welfare to operate. Failure to continue to fund the Bureau from GRF would cause the Bureau to cease functioning.
