Synopsis As Introduced
Amends the Department of Human Services Act. Provides that the Department of Human Services shall develop a plan for implementing 14 specified actions (relating primarily to activities of the Division of Alcoholism and Substance Abuse and the Division of Mental Health), including necessary legislative action and rule changes, so that all 14 actions can be implemented by January 1, 2013. Requires that the implementation plan include recommendations for necessary legislative action and changes in rules. Requires the Department to file the plan with the Governor and the General Assembly by January 1, 2012. Effective immediately.

House Committee Amendment No. 1
Replaces everything after the enacting clause with substantially similar provisions, amending the Department of Human Services Act, but with changes that include the following: (1) provides that the Department of Human Services shall implement the 14 specified actions no later than July 1, 2011 (instead of shall develop a plan for implementing the actions so that all of the actions can be implemented by January 1, 2013); (2) provides that one of the actions is "Evaluation of the staffing levels required for efficient operation of the Department's regional offices to maximize the amount of funding that is available to provide community-based services" (instead of "Elimination of the Department's regional offices to save significant State administrative costs that could be used for needed community mental health services"); (3) makes changes in other required actions; (4) eliminates a provision concerning recommendations for necessary legislative action and changes in rules; and (5) eliminates a provision requiring filing of an implementation plan by January 1, 2012. Effective immediately.

House Floor Amendment No. 2
Replaces everything after the enacting clause with similar provisions, amending the Department of Human Services Act, but with changes that include the following: (1) provides that the Department of Human Services shall develop a plan by July 1, 2011, for implementing the specified actions, and provides that the actions shall be implemented by January 1, 2012 (instead of July 1, 2011); (2) makes changes in the specified actions, including (i) adding references to outpatient level I and II.1 services, (ii) eliminating provisions concerning implementation of a single billing system and elimination of annual payment caps, (iii) adding a provision requiring payment to DASA and DMH providers no later than in the next fiscal year, and (iv) elimination of a provision concerning evaluation of staffing levels; (3) requires that the plan include recommendations for necessary legislative action and changes in rules; and (4) requires the Department to file the plan with the Governor and the General Assembly by July 1, 2011. Effective immediately.
