Synopsis As Introduced
Amends the Barber, Cosmetology, Esthetics, and Nail Technology Act of 1985. Changes the short title to the Barber, Cosmetology, Esthetics, Hair Braiding, and Nail Technology Act of 1985. Provides for the licensure of hair braiders and hair braiding teachers. Defines "hair braiding". Provides that a person licensed as a cosmetologist may engage in the practice of hair braiding without being licensed as a hair braider. Provides that a person licensed as a cosmetology teacher may teach hair braiding without being licensed as a hair braiding teacher. Sets out provisions concerning qualifications for licensure and renewal, including continuing education requirements. Provides that hair braiding schools may establish an internship program. Provides that the Department shall take no action against any unlicensed hair braider for acts that occurred prior to the effective date of the amendatory Act. Replaces all references to "Director" in the Act with "Secretary". Defines "Secretary", "licensed hair braider", and "licensed hair braiding teacher". Makes other changes. Updates cross-references to the new short title in the Regulatory Sunset Act and the Unified Code of Corrections.

In provisions concerning reciprocity for persons registered or licensed elsewhere as a cosmetologist, cosmetology teacher, or cosmetology clinic teacher, provides that an applicant registered or licensed under the laws of another state or territory of the United States may, without examination, be granted a license as a licensed cosmetologist, cosmetology teacher, or cosmetology clinic teacher, whichever is applicable, by the Department in its discretion if he or she: (1) meets the appropriate age requirement; (2) submits to the Department satisfactory evidence that the applicant is registered or licensed in another state or territory as a cosmetologist, cosmetology teacher, or cosmetology clinic teacher; and (3) has met any other requirements of the Act.

House Floor Amendment No. 2
Deletes everything after the enacting clause and re-inserts the bill as introduced, with the following changes: in a provision concerning cosmetologists, cosmetology teachers, and cosmetology clinic teachers registered or licensed elsewhere, provides that the Department, in its discretion and in accordance with the rules, may require the applicant to pass an examination as required by the Act; makes a change in a provision concerning hair braider qualifications for licensure; provides that the expiration date and renewal period for each license issued under the Act shall be set by rule; provides that within 2 years after the effective date of the amendatory Act, the Department may issue a hair braider license to any applicant who does not meet certain educational requirements if the applicant: (1) files an application, (2) pays the required fee, (3) has not committed an offense that would be grounds for discipline under the Act, and (4) is able to demonstrate to the Department through tax records or affidavits that he or she has practiced hair braiding for at least 2 consecutive years immediately prior to the date of his or her application; sets forth certain requirements for restoring a hair braider or hair braider teacher license that has been expired for more than 5 years; restores the number of Board members to 11; provides that only one Board member shall be a barber holding a current license; provides that the hair braider or hair braiding teacher initially appointed to the Board shall not be required to possess a license at the time of the appointment, but must meet certain specified requirements; and provides that 6 members of the Board shall constitute a quorum and that a majority is required for Board decisions.

 State Debt Impact Note, House Floor Amendment No. 2 (Government Forecasting & Accountability)
 HB 5783 (H-AM 2) would not change the amount of authorization for any type of State-issued or State-supported bond, and, therefore, would not affect the level of State indebtedness.

 HB 5783 (H-AM 2) does not amend the Pension Code and will have no fiscal impact upon any public pension fund or retirement system in Illinois.
