Synopsis As Introduced
Amends the Food Handling Regulation Enforcement Act. Deletes language concerning food service sanitation manager recertification. Provides that, beginning January 1, 2011, any individual seeking initial food service sanitation manager certification shall be required to pass the certification examination provided by the Department of Public Health. Provides that an individual seeking initial certification who fails to pass the certification examination shall be required to complete the educational requirements established by the Department before retaking the examination. Provides that an individual who has a current certification from another state where that state required the individual to pass a certification examination shall be issued a food service sanitation manager certification upon application and payment of the corresponding fee.

House Floor Amendment No. 1
Deletes everything after the enacting clause and reinserts the contents of the bill as introduced with the following changes. Restores current law with respect to recertification and the expiration of existing certificates. Changes references of January 1, 2011 to July 1, 2011. Provides that any individual seeking initial certification shall be required to complete a minimum of 7 hours of certification training approved by the Department of Public Health and successfully pass a certification examination. Deletes the provision that the educational requirements established by the Department shall only be required if the individual seeking initial certification fails to successfully pass the food service sanitation manager accredited certification examination and that if the individual seeking initial certification fails to pass the food service sanitation manager accredited certification examination, then the individual shall be required to complete the educational requirements established by the Department. Deletes the provision that beginning January 1, 2011, if an examination is required by the State for recertification, then the examination shall be an accredited certification examination. Sets forth definitions of "accredited certification examination" and "accrediting organization". Makes other changes.
