Synopsis As Introduced
Amends the Code of Civil Procedure. Provides that an action for damages for personal injury based on childhood sexual abuse must be commenced within 20 (instead of 10) years of the date the limitation period begins to run or within 20 (instead of 5) years of the date the person abused discovers or through the use of reasonable diligence should discover that the act of childhood sexual abuse occurred and the injury was caused by that abuse. The changes made apply to actions pending on the effective date as well as actions commenced on or after that date.

House Committee Amendment No. 1
Further amends the Code of Civil Procedure. Provides that the changes made to the limitation periods apply to actions commenced on or after the effective date of the amendatory Act if the action would not have been time barred under Public Act 93-356 prior to the effective date (instead of providing that the changes apply to actions pending on the effective date of the amendatory Act as well as actions commenced on or after the effective date).

Senate Floor Amendment No. 1
Further amends the Code of Civil Procedure. Provides that the changes made to the limitations on actions based on childhood sexual abuse apply to actions commenced on or after the effective date if the action would not have been time barred under any statute of limitations or statute of repose (instead of under Public Act 93-356) prior to the effective date.
