  8/17/2010HousePublic Act . . . . . . . . . 96-1437

Statutes Amended In Order of Appearance
220 ILCS 5/16-107.5

Synopsis As Introduced
Amends the Public Utilities Act. Provides that the term "eligible renewable electrical generating facility" includes a generator powered by agricultural residues, untreated and unadulterated wood waste, landscape trimmings, and livestock manure. Provides that for eligible customers (rather than only residential customers), the measuring of the flow of electricity in both directions at the same rate shall typically be accomplished through use of a single, bi-directional meter. Deletes language with respect to net metering for non-residential customers. Provides that the electricity provider shall continue to carry over any excess kilowatt-hour credits earned and apply those credits to subsequent billing periods to offset any customer-generator consumption in those billing periods until all credits are used or until service is terminated (instead of or until the end of the annualized period). Deletes language concerning (1) net metering for certain non-residential customers, (2) specified charges, (3) specified customer credits, and (4) the number of eligible customers for net metering. Provides that the meter aggregation shall be subject to the terms and conditions approved by the Illinois Commerce Commission in a proceeding establishing the rules applicable to meter aggregation under specified provisions, which shall commence no less than 180 days after the effective date of the amendatory Act and be completed within 365 days after the effective date of the amendatory Act. Effective immediately.

House Committee Amendment No. 1
Deletes reference to:
220 ILCS 5/16-107.5
Adds reference to:
220 ILCS 5/16-107.7 new

Replaces everything after the enacting clause. Amends the Electric Service Customer Choice and Rate Relief Law of 1997 in the Public Utilities Act. Sets forth the findings of the General Assembly. Creates the Net Metering Task Force, which shall be comprised of 10 members, with one of the members to be named as chairperson by the Governor. Provides that no later than January 1, 2011, the Task Force shall submit a report to the General Assembly recommending legislative and programmatic changes to the existing net metering law that shall be necessary to overcome existing barriers to net metering development in the State. Specifies the criteria for the content of the report. Provides that the Illinois Commerce Commission shall provide administrative support for the Task Force. Effective immediately.

Judicial Note, House Committee Amendment No. 1 (Admin Office of the Illinois Courts)
HB 6202 would neither increase nor decrease the number of judges needed in the State.

Pension Note (Government Forecasting & Accountability)
HB 6202 will have no fiscal impact on any pension fund or retirement system in Illinois.

Pension Note, House Committee Amendment No. 1 (Government Forecasting & Accountability)
HB 6202 (H-AM 1) will have no fiscal impact on any pension fund or retirement system in Illinois.

State Debt Impact Note (Government Forecasting & Accountability)
HB 6202 would not change the amount of authorization for any type of State-issued or State-supported bond, and, therefore, would not affect the level of State indebtedness.

State Debt Impact Note, House Committee Amendment No. 1 (Government Forecasting & Accountability)
HB 6202 (H-AM 1) would not change the amount of authorization for any type of State-issued or State-supported bond, and, therefore, would not affect the level of State indebtedness.

Housing Affordability Impact Note (Housing Development Authority)
The expanded categories of eligible renewable electrical generating facilities may increase opportunities for some homeowners to take advantage of said opportunities and achieve some utility cost savings. These cost savings would vary by individual owner, and depend on factors such as homeowners' utilty usage, location of the home, the type of renewable electrical generating facility installed, and the rate structure from the utility company serving that residential area.

Housing Affordability Impact Note, House Committee Amendment No. 1 (Housing Development Authority)
This bill will have no effect on the cost of constructing, purchasing, owning, or selling a single-family residence.

 Fiscal Note (Illinois Commerce Commission)
This legislation would require the Commission to create new meter aggregation rule. While this rule likely could be done using existing staff resources, they would probably have to be pulled off their other duties. The amount of staff time to create the rule is estimated at 500 staff hours; which would be the equivalent of about $30,000 in costs.

Fiscal Note, House Committee Amendment No. 1 (Illinois Commerce Commission)
It is hard to estimate the total time and work the task force would perform; and what their expectations would be of the Commission, but total cost in State employee time could range anywhere from $50,000 to $110,000 per year. The Commission's estimated portion of that cost would range from $6,200 to $66,200.

Home Rule Note (Dept. of Commerce & Economic Opportunity)
Does not pre-empt home rule authority.

Home Rule Note, House Committee Amendment No. 1 (Dept. of Commerce and Economic Opportunity)
Does not pre-empt home rule authority.

State Mandates Fiscal Note (Dept. of Commerce & Economic Opportunity)
Does not create a State mandate.

State Mandates Fiscal Note, House Committee Amendment No. 1 (Dept. of Commerce & Economic Opportunity)
Does not create a State mandate.

Balanced Budget Note (Office of Management and Budget)
HB 6202 would require an estimated 500 hours of additional workload for Commission employees, which are currently assigned other duties.

Land Conveyance Appraisal Note, House Committee Amendment No. 1 (Dept. of Transportation)
There are no Illinois Department of Transportation land conveyances or releases included in this bill, therefore, IDOT has no appraisals to be filed.

Land Conveyance Appraisal Note (Dept. of Transportation)
There are no Illinois Department of Transportation land conveyances or releases included in this bill, therefore, IDOT has no appraisals to be filed.

House Floor Amendment No. 2
Replaces everything after the enacting clause with the bill as amended by House Amendment No. 1 with the following changes. Makes changes in the General Assembly's findings. Increases the number of total members on the Net Metering Task Force by 6 members, all of which are Governor appointees representing various entities. Requires all appointments be made by August 2, 2010 (rather than July 1, 2010). Changes the language concerning the Task Force's report to provide that no later than March 1, 2011 (was, January 1, 2011), the Task Force shall submit a report to the General Assembly concerning the status of net metering in Illinois and whether any legislative and programmatic changes to the existing net metering law are necessary. Allows for minority reports to be included in the Task Force's report. Makes other changes regarding the Task Force's report. Effective immediately.

Amends the Public Utilities Act. Provides that for compliance years beginning prior to June 1, 2014, each alternative compliance payment rate shall be equal to the total amount of dollars that the utility contracted to spend on all renewable resources, excepting the additional incremental cost attributable to solar resources, for the compliance period divided by the forecasted load of eligible retail customers, at the customers' meters, as previously established in the Commission-approved procurement plan for that compliance year. Effective immediately.
