Synopsis As Introduced
Amends the Illinois Health Facilities Planning Act. Requires that the Illinois Health Facilities Planning Board, in collaboration with a subcommittee of the Older Adult Services Advisory Committee, review and revise the Bed Need Methodology for Long Term Care and analyze the nursing home bed needs at the State's township level. Effective immediately.

Replaces everything after the enacting clause. Amends the Illinois Act on the Aging and the State Finance Act; creates the Long Term Care Ombudsman Fund as a special fund in the State treasury to receive funds for the express purposes of the Long Term Care Ombudsman Program. Amends the Nursing Home Care Act. Provides that the Long Term Care Monitor/Receiver Fund is to be used for enforcement of the Act (in addition to other uses). Provides that the Department of Public Health may reduce or waive a penalty under the Nursing Home Care Act only if that action will not threaten the ability of the Department to meet the expenses required to be met by the Long Term Care Monitor/Receiver Fund. Provides that the Director of Public Health or his or her designee may reallocate the amount of a penalty assessed for a violation of the Act, and provides that the factors to be considered include that the facility did not benefit financially from committing or continuing the violation (instead of the financial benefit to the facility of committing or continuing the violation). Amends the Older Adult Services Act; creates the Nursing Home Conversion Fund as a special fund in the State treasury for the purposes of the nursing home conversion program. Effective immediately.
