Replaces everything after the enacting clause. Amends the Counties Code and the Water Commission Act of 1985. Provides that any water commission created under the Water Commission Act of 1985 is abolished on December 1, 2010. Provides that a county serviced by a water commission created under the Water Commission Act of 1985 shall assume all assets, property, rights, powers, monetary indebtedness duties, and functions of the water commission. Sets forth the requirements for the transfer of property from a water commission to a county. Provides that funds transferred from a water commission to a county shall be deposited into a water enterprise fund. Authorizes the county to impose specified taxes to repay the debts, obligations, and operating expenses incurred by a water commission. Limits home rule powers. Amends the State Mandates Act to require implementation without reimbursement. Effective immediately.

Replaces everything after the enacting clause. Amends the Counties Code, the Illinois Municipal Code, and the Water Commission Act of 1985. Provides that the powers assigned to a water commission under the Water Commission Act of 1985 and Division 135 of the Illinois Municipal Code are abrogated, reassigned, and consolidated in the primary county serviced by the water commission on December 10, 2010. Provides that funds transferred from a water commission to a county shall be deposited into a water enterprise fund. Authorizes the county to impose specified property taxes and occupation and use taxes. Limits home rule powers. Amends the State Mandates Act to require implementation without reimbursement. Contains other provisions. Effective immediately.

Further amends the Water Commission Act of 1985. Provides that on and after the effective date of the amendatory Act, specified occupation and use taxes shall be used by a county exclusively for capital infrastructure and related costs (now corporate purposes). If, on or after January 1, 2014, the proceeds from an occupation or use tax are not fully used for capital infrastructure and related costs, then the county may no longer impose or collect the occupation or use tax.

Provides that effective January 1, 2011, the terms of the commissioners serving on the water commission terminate. Sets forth the procedure for appointing new commissioners to the water commission. Requires the appointment of a general manager, a finance director, and a treasurer. Sets forth the powers and duties of a water commission. Provides that beginning June 1, 2016, specified occupation and use taxes may no longer be imposed or collected, unless a continuation of the tax is approved by the voters at a referendum. Effective immediately.
