Synopsis As Introduced
Amends the Community-Integrated Living Arrangements Licensure and Certification Act. Provides that the Department of Human Services shall (instead of may) conduct an investigation upon receipt of a complaint to insure that a community mental health or developmental services agency is in compliance with the Act. Provides that in connection with the operation of an agency without a license or permit, the Department shall (instead of may) investigate, notify the agency, and make referrals to investigatory or law enforcement agencies. Effective immediately.

Adds reference to:
210 ILCS 135/3from Ch. 91 1/2, par. 1703

Further amends the Community-Integrated Living Arrangements Licensure and Certification Act. Defines "investigation", for purposes of the Act, to mean a process that includes determination of facts and an assessment of their significance in relation to the provisions of the Act. Provides that the Department of Human Services shall adopt rules for identifying and addressing complaints that are nuisance, crank, or frivolous. Provides that the Department shall prioritize and address complaints according to the potential non-compliance with the provisions of the Act, as necessary to manage within existing resources.
