Synopsis As Introduced
Amends the Illinois Vehicle Code. Repeals a provision providing for the collection of an annual commercial distribution fee on vehicles of the second division weighing more than 8,000 pounds. Effective July 1, 2010.

Deletes everything after the enacting clause. Amends the Department of Transportation Law of the Civil Administrative Code of Illinois. Provides that the Department of Transportation shall develop and implement a life-cycle cost analysis for each State road project under its jurisdiction for which the total pavement costs exceed $500,000 funded in whole, or in part, with State or State appropriated funds, and provides that the Department of Transportation shall design and award these paving projects utilizing material having the lowest life-cycle cost. Defines "life-cycle cost" as the total of the cost of the initial project plus all anticipated costs for subsequent maintenance, repair, or resurfacing over the life of the pavement, and provides that actual data, and not assumptions or estimates, shall be used to the extent such data has been collected. Provides for exceptions to the life-cycle cost requirement and procedures for determining life-cycle cost of roadbuilding projects. Effective immediately.

House Floor Amendment No. 2
Redefines "life-cycle cost" as the total of the cost of the initial project plus all anticipated future costs (rather than all anticipated costs for subsequent maintenance, repair, or resurfacing) over the life of the pavement. Provides that actual, relevant data (rather than just actual data), and not assumptions or estimates, shall be used to the relevant extent such data has been collected. Replaces references to "historic project maintenance, repair, and resurfacing schedules" with "historic project schedules" in provisions describing life-cycle cost analysis.
