Synopsis As Introduced
Creates the Community Association Manager Act. Provides for the licensure of community association managers by the Department of Financial and Professional Regulation. Provides that no person may provide services as a community association manager to community associations in this State after January 1, 2011, unless he or she holds a current and valid license issued by the Department or is otherwise exempt from licensure under this Act. Creates the Community Association Manager Regulatory Commission. Sets forth provisions concerning qualifications for licensure, grounds for discipline under the Act, and certain administrative fees and procedures. Imposes conditions on any rulemaking authority. Amends the Regulatory Sunset Act to set a repeal date for the new Act of January 1, 2021. Amends the State Finance Act to create the Community Manager License Fund. Effective immediately.

Senate Committee Amendment No. 1
Provides that a Commission member, consultant, or witness shall be immune from liability in any civil action brought against him or her for acts occurring while acting in that capacity, unless the conduct that gave rise to the action was willful or wanton misconduct. Provides for licensure of legal permanent residents of the United States (now, only citizens). Specifies criminal offenses that disqualify an applicant for licensure, unless the Board provides the applicant a waiver for the conviction after taking into account certain factors.

Senate Floor Amendment No. 2
Makes technical changes to certain provisions of the Act.

Senate Floor Amendment No. 3
Provides that no applicant shall be qualified for licensure under the Act if he or she has been convicted of a felony.

House Floor Amendment No. 1
Deletes reference to:
765 ILCS 605/18.7 rep.

Replaces everything after the enacting clause. Creates the Community Association Manager Licensing and Disciplinary Act. Provides for the licensure of community association managers and community association management agencies by the Department of Financial and Professional Regulation. Provides that beginning 12 months after the adoption of rules providing for the licensure of a Community Association Management Agency or a community association manager under the Act, it shall be unlawful for any person, entity, or other business to provide community association management services or provide services as community association manager to any community association in this State, unless he or she holds a current and valid license issued licensed by the Department or is otherwise exempt from licensure under this Act. Creates the Community Association Manager Licensing and Disciplinary Board. Sets forth provisions concerning qualifications for licensure, grounds for discipline under the Act, and certain administrative fees and procedures. Amends the Regulatory Sunset Act to set a repeal date for the new Act of January 1, 2020. Amends the State Finance Act to include the Community Association Manager Licensing and Disciplinary Fund. Effective July 1, 2010.

House Floor Amendment No. 2
Provides that 4 Board members shall constitute a quorum and that a quorum is required for all Board decisions. Makes change to the definition of "community association manager". Changes cross-reference in a provision concerning the Illinois Administrative Procedure Act.
