Synopsis As Introduced
Amends the School Code. Requires each school superintendent to create a program to ensure that students attending the schools that he or she manages cannot access those schools' grounds for at least 12 hours after those grounds are treated with a lawn care product. Requires each district superintendent to appoint a Lawn Care Coordinator whose duty it shall be (i) to implement that program, (ii) to supervise the provision of notice under subdivision (f)(2) of Section 3 of the Lawn Care Products Application and Notice Act, and (3) if the district adopts a pesticide-free turf care program, to supervise that program. Amends the Lawn Care Products Application and Notice Act. Requires applicators for hire to provide additional types of information to customers. Requires the owners or operators of day care centers to provide parents with one of two types of notice before applying pesticide or having pesticide applied to day center grounds (now, only school districts must provide that notice). Requires the Illinois Department of Public Health to inform school boards and the owners and operators of day care centers about these requirements. Requires the Illinois Department of Public Health to report violations to the Department of Agriculture for enforcement. Effective immediately.

Further amends the School Code and the Lawn Care Products Application and Notice Act. Deletes a provision in the introduced bill that requires applicators for hire to, upon request, provide their customers with a copy of the material safety data sheet of each applied lawn care product. Inserts a provision that requires applicators for hire to, upon request, provide their customers or any person whose property abuts or is adjacent to the property of their customers with a copy of the material safety data sheet and approved pesticide registration label of each applied lawn care product. Provides that written notification required by the introduced bill may not occur by bulletin board. Increases the notification period from 2 to 4 days. Makes other technical changes. Amends the Child Care Act of 1969. Requires each licensed day care center to ensure (i) that lawn care products will not be applied to day care center grounds when children are present at the center or on its grounds and (ii) that children will not be able to access day care center grounds that have been treated with lawn care products for at least 12 hours after those grounds are treated with a lawn care product. Requires toys and other items mouthed or handled by children to be removed from the grounds before lawn care products are applied.

Senate Floor Amendment No. 2
Deletes everything after the enacting clause. Amends the School Code. Requires each school district and the Board of Education to adopt a procedure to comply with the requirements of the Lawn Care Products Application and Notice Act and the Structural Pest Control Act. Requires the designation of a staff person who is responsible for compliance with the requirements of those Acts. Amends the Child Care Act of 1969. Requires the owners and operators of licensed day care centers to ensure that lawn care products will not be applied to day care center grounds when children are present at a center or on its grounds. Amends the Lawn Care Products Application and Notice Act. Requires applicators for hire to provide, upon request, a copy of the approved pesticide registration label as well as the material safety data sheet for applied lawn care product to certain persons. Requires schools and day care centers to give parents written or telephonic notice 4 days before applying pesticide on day care grounds or school grounds (now, written notice must be given 2 days before pesticides are applied to school grounds). Effective immediately.
