Synopsis As Introduced
Amends the Riverboat Gambling Act. For a riverboat with annual adjusted gross receipts of less than $50,000,000, (i) eliminates the admissions tax and (ii) imposes an additional 1% privilege tax, the proceeds of which shall be paid monthly to the unit of local government that is designated as the home dock of the riverboat upon which those riverboat gambling operations are conducted. Effective immediately.

Senate Committee Amendment No. 1
Replaces everything after the enacting clause. Amends the Riverboat Gambling Act. Provides that, if the licensed owner of a riverboat in operation on January 1, 2009 has a capital project of at least $75,000,000 that is approved by the Illinois Gaming Board in calendar years 2006 through 2009, then no admissions tax is imposed on admissions to that riverboat. Provides that, if no admissions tax is imposed on admissions to a riverboat, then in addition to current privilege tax, a privilege tax of 1% of adjusted gross receipts is imposed on that riverboat, the proceeds of which shall be paid monthly to the unit of local government that is designated as the home dock of the riverboat upon which those riverboat gambling operations are conducted. Effective immediately.

Senate Floor Amendment No. 3
In provisions concerning admissions taxes, provides that, if the licensed owner of a riverboat in operation on January 1, 2009 has capital projects of at least $45,000,000 that are approved by the Board in calendar years 2006 through 2009 or for which at least $45,000,000 in expenditures have been made in calendar years 2006 through 2009 (was, if the licensed owner of a riverboat in operation on January 1, 2009 has a capital project of at least $75,000,000 that is approved by the Board in calendar years 2006 through 2009), then no admissions tax is imposed on admissions to that riverboat.

Amends the Riverboat Gambling Act. Separates the Illinois Gaming Board from the Department of Revenue for the purposes of enforcing and administering the Riverboat Gambling Act. Makes conforming changes. Prohibits members of the Board from holding any other public office (rather than any other public office for which he or she shall receive compensation) and from engaging in any political activity. Makes changes regarding disclosure of equity interests of the Board members and their spouses and children. In provisions concerning the powers and duties of the Board, removes language allowing the Director of Revenue to delegate responsibility for the administration and enforcement of certain Acts concerning gaming to the Board and adds language concerning contracts. Makes changes concerning appropriations from the State Gaming Fund. Makes other changes.
