Synopsis As Introduced
Amends the Military Code of Illinois. Authorizes the Department of Military Affairs, subject to appropriation, to also make grants from the Illinois Military Family Relief Fund to (i) Illinois residents who are active duty members of the armed forces of the United States or members of the reserves of the armed forces of the United States and who are wounded in combat while deployed in support of the global war on terrorism and (ii) the families of those persons. Provides that the Department must establish a casualty-based grant program.

House Committee Amendment No. 1
Further amends the Military Code of Illinois. In a provision concerning the power of the Department of Military Affairs to make grants from the Illinois Military Family Relief Fund, provides that (i) grants awarded from the Fund shall not be subject to garnishment, wage levy, forfeiture, or other remedy, unless the denial of that remedy is inconsistent with the requirements of any other State or federal law and (ii) the Department may use as much as 5% of appropriations designated for deposit into the Fund for administering the casualty-based grant program.

House Floor Amendment No. 5
Replaces everything after the enacting clause with provisions substantially similar to those of the introduced bill as amended by House Amendment No. 1, amending the Military Code of Illinois in relation to grants from the Illinois Military Family Relief Fund, but with changes that include the following: (1) in connection with eligibility for grants, eliminates a reference to "single persons"; (2) makes changes concerning casualty-based grants; (3) provides for grants to families of military personnel; (4) provides that on and after the effective date of the amendatory Act, the Department of Military Affairs must award at least $5,000 to each recipient of a casualty-based grant and must include Illinois residents who are active duty members of the armed forces of the United States in the eligibility for the casualty-based grant; and (5) provides that each recipient may receive only one casualty-based grant for injuries received during, or arising out of, the same engagement or incident. Effective immediately.
