Synopsis As Introduced
Amends the Environmental Protection Act. Authorizes the Illinois Pollution Control Board to stay the effectiveness of certain actions taken or permit conditions imposed by the Environmental Protection Agency in the course of administering the Clean Air Act Permit Program (CAAPP). Provides that if the Board stays any contested conditions, then any related conditions from any prior existing permit continue in full force and effect until the Board makes its final decision regarding the appeal of the granted CAAPP permit. Authorizes the Board to stay all the conditions in a CAAPP permit upon a demonstration that the issues raised on appeal can be reasonably expected to affect the CAAPP permit in its entirety. Provides that if the entire CAAPP permit is stayed by the Board, then any prior existing permit continues in full force and effect until the Board makes its final decision regarding the appeal of the granted CAAPP permit. Effective immediately.

Senate Committee Amendment No. 1
Provides that, if requested by the applicant, the Illinois Pollution Control Board may stay the effectiveness of certain final Agency actions. (In the introduced bill, there was not a requirement that a permit applicant request the stay.) Provides that, if requested by the applicant (rather than if simply requested), the Board shall (rather than may) stay the effectiveness of all contested conditions of a CAAPP permit (rather than any or all contested conditions of a CAAPP permit). Authorizes the Board to stay the effectiveness of any or all uncontested conditions of a CAAPP permit if the Board determines that the uncontested conditions would be affected by its review of the contested conditions. Provides that, if the Board stays any, but not all, (rather than any) conditions (rather than contested conditions) of a CAAPP permit, then the applicant for that permit shall continue to operate in accordance with "any" related terms and conditions of any other applicable permits until final Board action in the review process. Provides that, if the Board stays all conditions, then the applicant shall continue to operate in accordance with "all" related terms and conditions of any other applicable permits until final Board action in the review process. Provides that any stays granted by the Board shall be deemed effective upon the date of final Agency action appealed by the applicant. Provides that these provisions supersede a particular provision in the Illinois Administrative Procedure Act.
